Non-Muslim expatriates can file a divorce case in Dubai, UAE with the option to apply the law of their home country. However, acceptance or enforcement of the home country laws in UAE courts must be checked beforehand. If a home country’s law fails to cover an aspect of the divorce proceedings, the court can apply the UAE law to that aspect alone. Regardless of the parties’ profile, filing a divorce case in Dubai/UAE starts with the registration of the case by either party. The divorce petition can be submitted on their own or through a divorce lawyer at the Family Guidance court in the Emirate of residency. The first stage is a mandatory procedure where a court will appoint a conciliator. The conciliator will try to reconcile the parties and allow each party to raise their concerns without the presence of legal representatives. This stage can end in two ways. The first is an amicable or mutual divorce - where an agreement is drafted with the mutual consent and interests of both parties. Here the divorce is settled.

The second is to take the matter before the Court of First Instance. In the Court of First Instance, it is advisable to have legal representation. This is because having a professional who understands the language of the court is always reassuring. This procedure involves going back and forth with defences and counter-replies until the judge reaches a judgement.

From here, 28 days are given to move the case to the Appeal Court and another 28 days from the appeal judgement to move to the Cessation Court if needed. The case, in the last stage, goes to the Enforcement Court. Here, based on the judgements of the previous courts, the judge finalises the settlements and issues a verdict.

If a couple had concluded their consent divorce in the conciliatory stage, the matter skips the previous courts and lands directly in the Enforcement Court.
