Is A Bounced Cheque Still A Crime In The UAE?
Since the amendments in force from January 2022, a dishonoured cheque is generally enforced as a direct execution instrument through the civil execution court rather than prosecuted as a crime. Criminal liability remains where the drawer acted fraudulently, closed the account or ordered the bank to stop payment without lawful cause.
How Does Execution On A Bounced Cheque Work?
The holder files the returned cheque directly with the execution court, which can issue an order without a full trial and then attach bank accounts, salary, vehicles and property, and impose a travel ban on the debtor.
