Child Custody Lawyers in Dubai
Advice and court representation for parents on custody, guardianship, visitation, travel and child maintenance.
In short: UAE law separates custody (day-to-day care, usually with the mother) from guardianship (legal decisions, documents and finances, usually with the father). Under the Personal Status Law (Federal Decree-Law No. 41 of 2024), custody generally lasts until the child turns 18, and a child aged 15 or over may choose which parent to live with. For non-Muslim parents, Federal Decree-Law No. 41 of 2022 makes joint custody the starting point. In every case, the court decides on the child's welfare.
Custody is often the part of a separation that matters most and causes the most conflict. Early, careful steps protect both the child and your position in court.

What the Court Looks At
- Each parent's ability to care for the child, including health, conduct and home.
- The child's schooling, stability and existing routine.
- Any history of abuse, neglect or substance misuse.
- Whether one parent is obstructing contact with the other.
- The child's own wishes, depending on age.
Visitation, School and Travel
The parent without custody is normally entitled to regular visits and communication, set out in a court order or agreement. Decisions about schooling and passports usually involve the guardian. Travel is where disputes escalate most quickly:
- Taking a child out of the UAE without the other parent's consent or a court order can lead to serious legal consequences.
- Either parent can ask the court for a travel ban on the child if there is a real risk of removal.
- The UAE is not a party to the 1980 Hague Convention, so getting a child returned from abroad is difficult. Prevention matters.
Child Maintenance
The father, or the paying parent under the civil law, must cover the child's needs: housing, school fees, food, clothing and medical costs, based on his means and the child's standard of living. Unpaid maintenance is enforced through the execution court.
How a Custody Case Proceeds
- Family guidance session (for Muslim parents), where a settlement can be agreed and recorded.
- Filing with the Personal Status Court if there is no agreement.
- Evidence: school reports, medical records, witness statements, and sometimes a social worker's report.
- Judgment, with the right to appeal. Custody orders can later be varied if circumstances change.
Mistakes That Hurt a Custody Case
- Moving out with the children, or keeping them from the other parent, without advice.
- Discussing the case in front of the children or on social media.
- Not keeping a record of missed visits or unpaid maintenance.
Custody usually runs alongside a divorce; see our divorce lawyers, expat divorce lawyers and female lawyers. For guardianship after death, see our wills and guardianship lawyers.

Frequently Asked Questions
General guidance on this area of law. Advice on your own case requires your documents.
Who Gets Custody Of A Child After Divorce In Dubai?
Under the Personal Status Law, custody usually goes to the mother and guardianship to the father. For non-Muslim parents under the 2022 civil law, joint custody is the starting point. The court always decides based on the child's welfare.
Until What Age Does Custody Last In The UAE?
Under Federal Decree-Law No. 41 of 2024, custody generally continues until the child turns 18, for boys and girls. A child aged 15 or over may choose which parent to live with.
Can A Mother Lose Custody In Dubai?
Yes, if the court finds she is unfit, for example because of neglect, harm to the child, or other conduct that affects the child's welfare.
Can I Travel Abroad With My Child After Divorce?
Only with the other parent's consent or a court order. Travelling without either can lead to legal action, and the other parent may ask the court for a travel ban on the child.
How Is Child Maintenance Calculated In Dubai?
There is no fixed formula. The court considers the child's needs, including housing, school fees and medical costs, and the paying parent's income and means.
Can A Custody Order Be Changed Later?
Yes. Either parent can apply to vary custody, visitation or maintenance if circumstances change significantly, such as relocation or a change in the child's needs.
