What the 2022 Civil Law Means for Non-Muslim Expats
- No-fault divorce: either spouse can divorce without proving harm or the other's agreement.
- Joint custody: both parents share custody as the starting point.
- Alimony: the court can award maintenance to a spouse based on factors such as the length of the marriage, age, earning capacity and each party's contribution.
- Speed: the process is designed to be quicker than traditional procedures.
Assets, Property and Pensions
The UAE does not apply an automatic 50/50 split. Assets in one spouse's name usually stay with that spouse unless the court is persuaded otherwise. If significant assets are in a country with community property or equal-division rules, filing there may be better for one spouse, which is why timing matters.
