International Lawyers in Dubai

Legal support for cases that cross borders: foreign judgments, extradition, international business disputes and multi-country family matters.

In short: when a legal problem involves the UAE and another country, the key questions are which country's courts decide it, which law applies, and whether the result can be enforced where the assets or people are. The UAE enforces foreign judgments under its Civil Procedure Law and treaties such as the GCC and Riyadh conventions and bilateral agreements, including with India, France and China. Foreign arbitral awards are enforced under the New York Convention.

Enforcing a Foreign Judgment in Dubai

A foreign judgment is not automatically enforceable in the UAE. The creditor applies to the execution judge, who checks conditions including:

  • The foreign court had jurisdiction, and UAE courts did not have exclusive jurisdiction.
  • The defendant was properly notified and represented.
  • The judgment is final under the law of the issuing country.
  • It does not conflict with a UAE judgment or UAE public order.
  • Reciprocity or a treaty with the issuing country.

Documents must be legalised and translated into Arabic. In the other direction, UAE judgments can be enforced in countries with which the UAE has treaties, such as India, where the UAE is recognised as a reciprocating territory.

Serving Documents and Gathering Evidence Abroad

Serving a claim on a party abroad, or obtaining evidence from another country, goes through judicial cooperation channels under UAE law and applicable treaties. This can add months to a case, so it should be planned from the start.

Working With Lawyers in Other Countries

For matters needing action abroad, we work alongside lawyers in the other country and coordinate strategy so that steps taken in one place do not damage the case in the other.

Common Mistakes

  • Winning a judgment in a country where the debtor has no assets.
  • Filing cases in two countries without coordinating them.
  • Ignoring a foreign case because "it cannot be enforced here".

Frequently Asked Questions

General guidance on this area of law. Advice on your own case requires your documents.

Can A Foreign Court Judgment Be Enforced In Dubai?

Yes, if the conditions are met: jurisdiction, proper notice, finality, no conflict with UAE public order or judgments, and reciprocity or a treaty with the issuing country.

Is A UAE Judgment Enforceable In India?

Yes. India has recognised the UAE as a reciprocating territory, so UAE court judgments can be executed in India like domestic decrees, subject to Indian law.

Does The UAE Extradite People To Other Countries?

Yes, under UAE law and treaties, after a formal request and a court review. See our INTERPOL lawyers page for details.

How Are Legal Documents Served On Someone Abroad From Dubai?

Through judicial cooperation channels under UAE law and treaties, or by methods the court allows. This can take several months.
